General Terms and Conditions of Sale (GTC)

1. Preamble

These General Terms and Conditions of Sale (hereinafter "GTC") apply to all orders placed on the Mon Petit Atelier website operated by the company Mon Petit Atelier, whose registered office is located at Impasse Bel Air, 73100 Gresy sur Aix, registered under number 918 672 049.

By placing an order, the customer acknowledges having read, understood and accepted these Terms and Conditions without reservation.

2. Products

The products offered are jewelry created and/or assembled by hand.

Each piece is handcrafted and may have slight variations in shape, color or size, which is not a defect.

The essential characteristics of the products (photos, descriptions, materials, dimensions) are presented on the site with the greatest possible accuracy.

3. Price

Prices are shown in euros (€), including all taxes (TTC).

They do not include delivery charges, which are calculated at the time of ordering based on the customer's address and the chosen shipping method.

The company reserves the right to change its prices at any time, but products will be billed based on the price in effect at the time the order is validated.

4. Orders

The customer can place an order on the website by following the online process.

An order is considered valid after:

  • shopping cart validation
  • acceptance of these Terms and Conditions,
  • full payment of the price.

The company reserves the right to refuse any order in the event of a prior dispute with the customer or for any other legitimate reason.

5. Payment

Payments are secure and can be made via:

  • Bank card,
  • PayPal,
  • Shopify Payments,
  • Another option if specified on the website.

The order will only be processed after payment has been validated.

6. Delivery

The jewelry is shipped to the address provided by the customer when placing the order.

Time limit

Shipping times vary between 1 and 5 working days depending on availability and the handcrafted nature of the creation.

Transportation

The company cannot be held responsible for delays, losses or damages caused by the carrier.

7. Right of withdrawal

In accordance with the law, the customer has a period of 14 days from receipt of the product to exercise their right of withdrawal.

Exceptions

The right of withdrawal does not apply to:

  • Personalized or custom-made jewelry (initials, specific size, engraving, custom design),
  • hygiene products (earrings)
  • worn or damaged products.

To exercise the right of withdrawal, the customer must send a request to:

Products must be returned new, unworn, in their original packaging.

Products must be returned with a tracking number.

Return shipping costs are the responsibility of the customer.

8. Reimbursement

After receiving and verifying the returned product, the refund will be issued within 14 days, via the same payment method used for the order.

9. Guarantees

The products benefit from:

  • of the legal guarantee of conformity,
  • of the guarantee against hidden defects.

The following are not covered:

  • normal wear and tear,
  • mistreatment (shocks, contact with water or chemicals, etc.),
  • the natural oxidation of metals.

10. Intellectual Property

All elements of the site (photos, texts, jewelry designs, logos, etc.) are the exclusive property of the company.

Any reproduction, in whole or in part, is strictly prohibited.

11. Protection of personal data

The customer's data is used solely for processing their order.

They are never resold.

In accordance with the GDPR, the customer may request:

  • access,
  • the modification,
  • the deletion of his personal data

12. Applicable Law and Disputes

These Terms and Conditions are governed by French law.

In the event of a dispute, an amicable solution will be sought.

Failing that, the competent court will be that of the defendant's domicile or the place of delivery.
